Greene County court upholds Springfield smoking ban

SPRINGFIELD — Although a Greene County court upheld Springfield's smoking ban, the legal fight over the issue is likely not over.

Greene County Judge Jason Brown upheld the smoking ban on Wednesday. It was approved by voters in April and went into effect June 11. The ban essentially prohibits smoking inside most buildings and outside in playgrounds and other areas.

A bar owner in Springfield sued in June to stop the ban. Jean Doublin, owner of Ruthie's Bar, claims in the lawsuit that the ordinance violates state law. Her attorney had said previously that he would appeal if Brown ruled against his client.

The Springfield News-Leader reported that supporters of the ban said there is growing legal precedent that gives cities the authority to enforce smoking bans to protect public health.
