Neighborhood Association files noise violation against Brookside on College complex

COLUMBIA — The Columbia City Public Works Department has issued a noise violation against the Trittenbach Development group, which owns the Brookside on College complex.

City Manager Mike Matthes confirmed the violation had been written and filed to the group on Friday, which alleges that construction on the Brookside on College complex was taking place after hours designated in Section 16 of the city ordinance.

According to the section, it is unlawful to disturb the peace by demolishing, constructing, altering or repairing any structure other than between the hours of 7 a.m. and 7 p.m. on weekdays and between 9 a.m. and 5 p.m. on Saturdays.

The violation came after Pat Fowler, president of the North Central Columbia Neighborhood Association Board, questioned the permit and permit compliance situation regarding the Brookside development on College Avenue in an email to Matthes.

After the fire at the complex in May, the Trittenbach Development group received an extended work hours permit to clean up excess debris associated with the fire.

However, according to city Building and Site Development Manager Shane Creech, the group does not currently hold such a permit.

"I am confident that the contractor is well aware of the city's ordinance, how to obtain an extended work hours permit and how to handle complaints associated with work after hours," Creech said.

Matthes said he hopes the issue is just a misunderstanding about city rules.

"I'm just glad that someone brought this to our attention so we could handle it," he said.

This must be why Brookside is renting apartments with bedrooms that don't have any windows. Can't hear any construction noise outside that way!

Really you actually cried because someone you just met did not have a window? Maybe your using too much of your emotion when at work.
