Donnelly's AG recount lawsuit dismissed

JEFFERSON CITY — Two absentee and provisional ballots cast during August's primary will be tallied after a lawsuit filed by a losing candidate in the Democratic attorney general race.

Margaret Donnelly sued to have more than 800 rejected absentee and provisional ballots reconsidered. Donnelly also requested a statewide re-count of the votes that were counted.

Sen. Chris Koster, of Raymore, beat Donnelly, of St. Louis, by 780 votes out of the more than 346,000 cast in the four-way primary. State law allows for a losing candidate to request a re-count when the margin is less than one percentage point.

Donnelly and Koster on Tuesday agreed to count two additional ballots from Jackson County and to dismiss the lawsuit.
