Attorney General urges court to deny stay of execution request

ST. LOUIS — The state's top prosecutor is urging the Missouri Supreme Court not to grant a stay of execution for a condemned prisoner scheduled to die next month.

Attorney General Chris Koster told the Supreme Court in documents filed Friday that the basis of Dennis Skillicorn's stay request is without merit. He said Skillicorn's case won't succeed.

Skillicorn's attorney, Jennifer Merrigan, asked a federal judge to stop Gov. Jay Nixon from being the one to decide on clemency for Skillicorn. Merrigan wants the court to convene a board to decide the matter.

She asked the state Supreme Court to postpone Skillicorn's scheduled May 20 execution until the federal matter is resolved.

Skillicorn was one of three men convicted of killing an Excelsior Springs businessman in 1994.
