OAKVIEW — An 88-year-old man sued the tiny Kansas City suburb of Oakview for $5 million, claiming police brutality.
Phillip Forte claims Oakview police officer Kimberly Whyley broke his arm during a Feb. 12 traffic stop.
The lawsuit says Forte was pulled over for driving with no headlights in the dark. It says that while Whyley sat in her patrol car writing Forte a ticket, he accidentally took his foot off the brake and his vehicle rolled back into her car, causing the officer to become enraged.
The 38-year-old Whyley is on paid leave and facing a misdemeanor assault charge in the incident. But her attorney, Bill Shull, said her dashboard camera shows Forte resisting arrest.
