Dismissal of charges sought in Kahler killings

LYNDON, Kan. — An attorney for James Kraig Kahler is seeking to have the charges dismissed or have all prosecuting attorneys and investigators removed from the case.

The Topeka Capital-Journal reports that Topeka attorney Tom Haney argues that prosecutors and investigators violated James Kahler's constitutional rights with search warrants used to obtain confidential records.

Kahler, former director of Columbia Water and Light, faces capital murder charges in deaths of his wife, two daughters and his grandmother-in-law on Nov. 28, 2009, in Burlingame, Kan.

A hearing is scheduled Tuesday in Osage County District Court to hear arguments on Haney's motion.
