UPDATE: Judge denies motion to dismiss Kahler murder case

LYNDON, Kan. — A northeast Kansas judge has refused to dismiss the capital murder case against James Kraig Kahler.
Osage County Magistrate Judge Jon Stephen Jones also refused Tuesday to disqualify prosecutors handling the case against Kahler, former director of Columbia Water and Light.

Kahler is accused of shooting his estranged wife, their two daughters and the wife's grandmother on Nov. 28, 2009, at the grandmother's home near Burlingame, Kan.
His attorneys argued the case was tainted because authorities seized documents related to a divorce case filed by his wife and a domestic assault case in Columbia.
But Jones ruled any taint from the documents could be eliminated by keeping them out of evidence.
