U.S. Department of Justice wants health care lawsuit dismissed

CAPE GIRARDEAU — The U.S. Department of Justice is asking a federal judge to dismiss a lawsuit filed by Missouri Lt. Gov. Peter Kinder to challenge the federal health care overhaul.
Kinder filed his lawsuit last year in federal court in Cape Girardeau. He contends the federal health care overhaul is overreaching and will harm the state's senior citizens.
The Southeast Missourian in Cape Girardeau reported Wednesday that the Department of Justice contends the lawsuit should be dismissed because Kinder does not have standing to sue.

Kinder, a Republican, said he will contest the federal government's request in February court filings. Kinder said the Department of Justice appears to be "phoning it in" because it did not address the substance of his lawsuit.
