COLUMBIA — Derrick Washington appeared in court Monday with his attorney, Christopher Slusher, to orally waive his right to a jury sentencing in his deviate sexual assault trial.
If a jury finds Washington guilty of deviate sexual assault, and if certain paperwork is filed on time, Circuit Court Judge Kevin Crane will determine Washington's sentence. That paperwork must be filed before 9 a.m. on Sept. 20, when Washington's jury trial is scheduled to begin.
- Former Missouri running back Derrick Washington and assistant prosecutor Andrea Hayes were in court Monday for pretrial motions in Washington's pending deviant sexual assault case. Washington's trial is scheduled to begin with jury selection Sept. 20.
Boone County Assistant Prosecuting Attorney Andrea Hayes requested a pool of 80 to 100 potential jurors for the trial. Hayes said she requested a high number due to the nature of the trial.
"For sexual assault cases, we call more than the average number of jurors because many people have trouble sitting through that type of case," she said.
Washington's attorney filed four other motions related to the publicity the case against the former Missouri running back has received; Hayes made no objections to these motions in court. Slusher's motions included requests that:
- The court instruct family and friends observing the trial to keep their emotions under control in the gallery.
- A rule be put in place before the jury selection process to prohibit witnesses, except for the victim, to sit in the courtroom during the trial.
- The court prohibit the state from using information not made available to the defense.
- That the state be required to inform the defense of any witness's criminal history.
In a separate incident, Washington is also charged with third-degree domestic assault. His court trial for that charge, which has been continued several times, is currently schedule for 1:30 p.m. on Sept. 30, in front of Boone County Associate Circuit Judge Deborah Daniels.
