A Columbia man was charged with rape of an underage girl Thursday morning after the victim said he forced himself on her while she was asleep.

Samuel Lee Moss Jr., 22, was charged with first-degree rape and second-degree statutory rape.

According to a probable cause statement, the victim said she was asleep at a friend’s house during the night of Nov. 9 and morning of Nov. 10 when she woke up to Moss having sex with her. The victim said that after she sat up, Moss asked her to let him continue.

The victim said that despite telling Moss no, he continued having sex with her. After the assault, Moss left the residence, according to the statement.

A registered sex offender, Moss was convicted of second-degree sexual abuse in July 2016. Moss was also arrested on Nov. 25, 2016, for armed criminal action and unlawful use of weapons.

Moss was being held on a $100,000 bond in the Boone County Jail as of Friday afternoon.
